These are essentially agreements entered into before marriage which deal with the couple’s assets and what is to happen in the event that the marriage breaks down by separation or divorce

They are entirely different from marriage settlements and are simply a legal contract entered into before or during a marriage and made in consideration of that marriage. Although highly persuasive to a Court on a divorce settlement, they are not binding as the Court has an absolute discretion when dividing-up matrimonial assets.
