The practicalities of a marriage breakdown often result in this situation which is not uncommon. I see no reason why the fact that you are still living under the same roof with your wife should have any effect on the only concern for the court which is whether the marriage has irretrievably broken down and that one of the five ' facts ' exist to establish this.
