Removal from the Jurisdiction

An application to the Court by a parent with residence or parental responsibility for leave to remove a child from the UK to live permanently overseas


A parent who wishes to take a child abroad (which includes Scotland) for more than one month must obtain the other parent with parental responsibility written consent first. Otherwise it is a criminal offence to take the child.
If this consent is not forthcoming and the other parent objects to the child being taken overseas it will be necessary to apply to the Court for permission. This package contains all that is necessary to guide you through the process.
